 1 Scope

(1) LVG-Kunstservice GmbH (hereinafter "we") processes your online order based on the following General Terms and Conditions ("GTC") in the version valid at the time of your order.

2. Conclusion of Contract

(1) All information regarding products, product features, and prices is subject to change due to errors. Our offer is non-binding.
(2) After placing an order, we will first confirm receipt of your order. You are required to inform us of any discrepancies between this confirmation and your order.
(3) The contract is only accepted by us upon delivery of the goods.

3.Rightt of Withdrawl

(1) Beginning of the Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party appointed by you, who is not the carrier, took possession of the last good. To exercise your right of withdrawal, you must inform us (LVG-Kunstservice GmbH, Berck-sur-Mer-Str. 20, 53604 Bad Honnef, Tel. 02224 900456, Fax 022224 900457, E-mail: info@littevangogh.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post, fax, or email). You can use the model withdrawal form for this, but it is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
If you withdraw from this contract, we will refund the payment we received from you without delay, and no later than fourteen days from the day we received the notification of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you incur any charges for this refund. You must return the goods to us without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract, to LVG-Kunstservice GmbH, Berck-sur-Mer-Str. 20, 53604 Bad Honnef. The deadline is met if you send the goods before the fourteen-day period expires. You will bear the direct costs of returning the goods. The costs are estimated to be no more than approximately 30 Euros. You will only be required to pay for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary for checking the condition, properties, and functionality of the goods. Please understand that custom-made shadow gap frames, provided they are free from defects, are excluded from return. The frames are made specifically for the artwork and customized according to customer specifications.

4. Delivery / Shipping Costs

(1) We are happy to provide you with information about the delivery time upon request.
(2) Since our original artworks travel nationwide in corporate exhibitions, our delivery times vary widely. We will therefore discuss the delivery time with you in advance. Typically, we deliver within 1-4 weeks. The maximum delivery time is 3 months. We thank you for your understanding.
(3) For shipping, packaging, and insurance, we charge a flat rate of 50 EUR per delivery within Germany and Austria. Additional costs may apply for delivery to Switzerland. Please feel free to contact us before placing your order so that we can discuss the delivery costs to Switzerland with you.

5. Payment Terms and Retention of Title

(1) Delivery is subject to advance payment.

(2) Our prices include the currently applicable German VAT.

(3) Until full payment is made, the delivered goods remain our property.

(4) If you fall into arrears with payment, we are entitled to charge default interest.

6. Warranty and Liability

(1) The warranty is provided in accordance with the statutory provisions, whereby in the event of a defect in the goods, we will either deliver a replacement or repair the goods at our discretion. If the repair fails or the replacement goods are also defective, you may return the goods for a full refund of the purchase price, or you can keep the goods and request a reduction in the purchase price.

7. Data Protection

(1) We use the data you provide to fulfill and process your order. All personal data is treated confidentially. The strict regulations of the Federal Data Protection Act are strictly adhered to. The data you provide and which is necessary for the transaction will be stored electronically. The data required for order processing will be passed on to the relevant service partners (e.g., the logistics company responsible for delivery, the bank handling the payment). To protect our legitimate interests, your name and address may be shared for creditworthiness checks. Your rights will be respected in accordance with the legal provisions. We use and transmit your name and postal address only to carefully selected companies whose products may be of interest to you, and which may send you interesting offers by mail. The data transmitted is limited to the necessary minimum. You can revoke the use, processing, and transmission of data for marketing purposes at any time.
